1. Introduction

These Terms & Conditions govern your use of Heart Beats, a daily wellness check-in service operated by Qfind AB.

2. Acceptance of terms

By creating an account you agree to these terms. If you do not agree, do not use the service.

3. Description of service

Heart Beats is a daily wellness check-in application that allows users to send a daily heartbeat signal to designated contacts (ICE contacts) who can acknowledge receipt.

Heart Beats is NOT a medical device, emergency service, or substitute for emergency services. In case of emergency always call 112 (EU) or your local emergency number.

4. User accounts

• You must be 18 or older to use the service.
• You are responsible for maintaining the security of your account.
• One account per person.
• You must provide accurate information.
• Qfind AB may terminate accounts for misuse.

5. ICE contacts

• Elder users may designate up to 5 ICE contacts.
• ICE contacts must consent to receiving notifications by accepting an invitation.
• ICE contacts are volunteers — Heart Beats does not guarantee a response from any contact.
• The elder is responsible for keeping their ICE contact list current and accurate.

6. Health data

• Heart Beats may read health data from Apple HealthKit with your explicit permission.
• Health data is optional and only shared with your designated ICE contacts.
• Health data is never used for advertising or sold to third parties.
• Heart Beats is not a medical device, and health data shown is not medical advice.

8. Service availability

We aim to provide a reliable service but cannot guarantee uninterrupted availability. The service may be temporarily unavailable due to maintenance or circumstances beyond our control. We are not liable for any consequences of service unavailability.

9. Limitation of liability

To the maximum extent permitted by Swedish law, Qfind AB is not liable for any indirect, incidental, or consequential damages arising from use of Heart Beats. Our total liability shall not exceed the amount paid by you for the service in the 12 months preceding the claim (or SEK 100 if the service was free).

10. Intellectual property

Heart Beats and all related content are owned by Qfind AB. You may not copy, modify or distribute any part of the service without written permission.

11. Changes to terms

We may update these terms and will notify users by email of material changes. Continued use after notification constitutes acceptance of the updated terms.

12. Termination

Qfind AB may suspend or terminate your account for violation of these terms, misuse of the service, or any conduct harmful to other users or the service. You may delete your account at any time by contacting team@myheartbeats.app.

13. Governing law and disputes

These terms are governed by Swedish law. Any disputes shall be finally settled by arbitration administered by the Stockholm Chamber of Commerce (SCC) Arbitration Institute under its rules. The seat of arbitration shall be Stockholm, Sweden. The language of arbitration shall be Swedish or English.
